Forward Fuel tank

While I was moving the forward

While I was moving the forward bunks in my 25 CC Explorer I found a fuel tank under the bunk. Is this legal to use. I checked and it is properly vented has SS tubing running back to the engine. The tank appears to be aluminum but it is definity dry right now. Not sure if I can use it or should I just remove it.
